This accident occurred just four months after Lohan was involved in another car crash that occurred just blocks away from Tuesday's incident after a paparazzi allegedly rammed the movie star's $180,000 Mercedes SL65 coupe in a bid to get a dramatic photograph of her. The paparazzi was arrested and charged for assault with a deadly weapon after Lohan had suffered neck injuries.
After this incident, the Governor of California Arnold Schwarzenegger created a new law toughening the civil penalties against paparazzi who commit assault while pursuing a subject.
However, police say that this time the paparazzi are not to blame for Lindsay?s accident. Lohan?s publicist, Leslie Sloan Zelnick, had claimed shutterbugs caused the accident, but the Los Angeles Sheriff's Department says "the paparazzi were not a factor".
However, the actress's spokeswoman still insists the pursuing photographers "didn't help". She said, "We don't blame them. But they were hounding her, and she was scared. The first time it was a paparazzi running into her, and this time she was trying to get away by driving out of the area," Sloan said warning that the growing competition for unusual celebrity pictures could lead to tragedy.
The accident was reportedly caused by a delivery van "turning in front of" Lindsay's Mercedes Benz, causing her to crash into it. The van driver, a local restaurant employee, illegally did a u-turn and collided with Lohan but he says that Lindsay was speeding.
The 19-year-old Hollywood starlet and her passenger, believed to be her assistant, were taken to hospital to be treated for cuts and scrapes, while the driver of the red minivan suffered "moderate" injuries but was released from hospital after treatment, police said.
